Welcome to Fetch Prospect. These Terms and Conditions (“Terms”) govern your access to and use of the Fetch Prospect website, Chrome extension, and related services (collectively, the “Service”).

By purchasing a license, downloading the extension, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Description of Service

Fetch Prospect is a localized, browser-based Customer Relationship Management (CRM) and automation tool designed to assist with Linkedin. The Service operates directly within your browser and automates actions on your behalf using your local IP address and active linkedin media sessions.

2. License Grant and Restrictions

Subject to your compliance with these Terms and payment of applicable fees (including our Lifetime Deal), Fetch Prospect grants you a limited, non-exclusive, non-transferable, and revocable license to install and use the Fetch Prospect Chrome extension for your personal or internal business use.

You agree not to:

  • Modify, reverse engineer, decompile, or disassemble the Service.
  • Rent, lease, lend, sell, redistribute, or sublicense the Service.
  • Use the Service for any illegal or unauthorized purpose.
  • Bypass or circumvent any security features of the Service.

3. Linkedin Platform Compliance & Account Risk

Fetch Prospect automates actions on third-party platforms including, but not limited to, LinkedIn, X (formerly Twitter), Instagram, and Facebook.

  • Platform Terms: You are solely responsible for complying with the Terms of Service, User Agreements, and anti-spam policies of any third-party linkedin media platform you interact with using our Service.
  • Assumption of Risk: While Fetch Prospect is designed to mimic human behavior operating from your local IP address, linkedin media platforms continuously update their anti-automation detection systems. You expressly acknowledge and agree that using automation tools carries an inherent risk of account restriction, suspension, or permanent banning.
  • No Liability for Bans: Fetch Prospect shall not be held liable for any account restrictions, bans, loss of network connections, or damages resulting from your use of the Service on third-party platforms.

4. Bring Your Own Key (BYOK) & AI Usage

Fetch Prospect utilizes artificial intelligence to generate personalized messages. We do not provide the underlying AI models directly.

  • Third-Party APIs: You must provide your own API key (OpenRouter) to utilize the generation features of the Service.
  • API Costs and Compliance: You are solely responsible for any costs, fees, or usage limits incurred through your chosen AI provider. You are also responsible for complying with the Acceptable Use Policies of your chosen AI provider. Fetch Prospect is not liable for API overages or disabled API keys.

5. Local Data Storage & Backups

Fetch Prospect is a “local-first” tool. Your CRM data, prospects, campaigns, and interaction history are stored locally on your device’s browser using local storage.

  • No Cloud Backups: We do not host, sync, or backup your CRM data on our servers.
  • Data Loss: If you clear your browser’s site data, uninstall the extension, or experience a hardware failure, your CRM data will be permanently lost. You are solely responsible for regularly exporting and backing up your data using the provided export tools. Fetch Prospect is not liable for any lost data.

6. Acceptable Use and Anti-Spam Policy

You agree to use Fetch Prospect in a professional and ethical manner. You must not use the Service to:

  • Send unsolicited, irrelevant, or harassing messages (Spam).
  • Promote illegal activities, hate speech, or explicit content.
  • Deceive, mislead, or defraud prospects.We reserve the right to revoke your license without a refund if we determine, in our sole discretion, that you are using the Service for abusive or malicious purposes.

7. Payments, Lifetime Deals, and Refunds

  • Payments: All payments are processed securely through our third-party payment processor (e.g., Stripe and Razorpay).
  • Lifetime Deal (LTD): If you purchased a “Lifetime Deal,” this grants you access to the Service for the lifespan of the Fetch Prospect product. It includes all future minor and major updates to the core extension. It does not guarantee that the Service will exist in perpetuity.
  • Refund Policy: We offer a 7 days money-back guarantee. If you are unsatisfied with the Service, you may request a full refund within 7 days of your original purchase. After this period, all sales are final.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. FETCH PROSPECT EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE FROM PLATFORM DETECTION ALGORITHMS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FETCH PROSPECT, ITS FOUNDERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OR INABILITY TO USE THE SERVICE; (B) ANY ACTIONS TAKEN BY THIRD-PARTY PLATFORMS (E.G., ACCOUNT BANS) AGAINST YOU. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICE.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Insert Your State/Country], without regard to its conflict of law principles.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. Your continued use of the Service following the posting of any changes constitutes acceptance of those changes.
